This Privacy Policy (the “Policy”) explains how Prism Executive Search, LLC (the “Company,” “we,” “us,” or “our”) processes Personal Data collected from you (the “Subscriber”) in our capacity as a Controller.
1. DEFINITIONS
(a) “Controller” means the natural or legal person, public authority, agency, or other body which determines the purposes and means of processing Personal Data.
(b) “Personal Data” means any information relating to an identified or identifiable natural person (“data subject”), including identifiers such as a name, identification number, location data, online identifier, or factors specific to the individual’s identity.
(c) “Service(s)” means staffing and recruiting services.
(d) “Subscriber” means any individual or entity that accesses or uses the Service(s).
(e) “Terms” means the agreement governing access to and use of the Service(s).
2. DATA COLLECTION
Subscribers provide most of the Personal Data collected by the Company. The Company collects the following categories of Personal Data:
(a) Contact Information – including name, email address, phone number, and mailing address.
(b) Professional Information – including resumes, employment history, qualifications, references, and recruiting-related information.
(c) Communications Data – including messages, emails, and other correspondence with the Company.
(d) Technical Data – including IP address, browser type, device information, and website usage data (where applicable).
The Company collects Personal Data through direct interactions, use of its website or services, and communications with Subscribers.
3. COOKIES AND TRACKING TECHNOLOGIES
The Company may use cookies, tracking pixels, and similar technologies to collect information regarding how Subscribers interact with its website or services. This information is used to improve functionality, analyze usage, and enhance the user experience.
Subscribers may adjust browser settings to refuse or disable cookies; however, doing so may impact the availability or functionality of certain features of the Service(s).
4. PROCESSING OF PERSONAL DATA
(a) The Company processes Personal Data as necessary to provide and improve the Service(s).
(b) The Company processes Personal Data where necessary to:
• perform a contract with the Subscriber;
• pursue legitimate business interests not overridden by the Subscriber’s rights; or
• comply with legal obligations.
(c) Where processing is based on consent, the Subscriber may withdraw consent at any time.
5. SHARING OF PERSONAL DATA
(a) The Subscriber acknowledges that the Company may share Personal Data with affiliated entities and third-party service providers to deliver the Service(s) and communicate relevant information.
(b) The Company may use third-party services, including credit reference agencies where applicable, to prevent fraud and verify transactions.
(c) The Company does not sell Personal Data. Personal Data is shared only as necessary for legitimate business purposes and subject to appropriate confidentiality obligations.
(d) No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties
6. RETENTION OF PERSONAL DATA
(a) The Company retains Personal Data only for as long as necessary to fulfill the purposes outlined in this Policy, including providing services, complying with legal obligations, resolving disputes, and enforcing agreements.
(b) When Personal Data is no longer required, the Company will delete, anonymize, or securely store it until deletion is possible.
7. SECURITY OF PERSONAL DATA
The Company implements reasonable administrative, technical, and physical safeguards to protect Personal Data. However, no method of transmission or storage is completely secure.
8. MODIFICATIONS
The Company may update this Policy from time to time. Material changes will be communicated where required by law.
9. YOUR PRIVACY RIGHTS
Depending on applicable law, Subscribers may have the right to:
(a) Access Personal Data;
(b) Correct inaccurate Personal Data;
(c) Request deletion of Personal Data;
(d) Opt out of certain data processing activities.

10. CHILDREN’S PRIVACY
The Company does not knowingly collect Personal Data from individuals under 13 years of age. If such data is identified, it will be promptly deleted.
11. BUSINESS TRANSFERS
In the event of a merger, acquisition, or sale of assets, Personal Data may be transferred as part of the transaction.
